Discipline and Promotional Appeals

The Industrial Relations Commission (IRC) started hearing public sector disciplinary and promotions appeals on 1 July 2010. These appeals were previously heard by the Government and Related Employee Appeals Tribunal (GREAT) which was abolished on the same date.

Excluded Groups

Those public sector employee groups excluded from appealing to GREAT continue to be excluded from appealing to the IRC (See the Industrial Relations Act 1996, s92).

Those public sector employee groups covered by the instruments, other agreements, contracts, understandings or undertakings listed below are also excluded from appealing promotion or disciplinary decisions. This is not a comprehensive list of all excluded employees as legislation and regulations may also prohibit or restrict employees’ appeal rights.

Note: The above MOUs exclude all employees engaged under the Health Services Act 1997 with the exception of Skilled Trades Staff and Operational Ambulance Officers and Managers.
